1. Digital Millennium Copyright Act Compliance

Pontopia.com respects the intellectual property rights of others and complies with the provisions of the Digital Millennium Copyright Act (“DMCA”). If you believe that content on this site infringes your copyright, you may submit a proper DMCA takedown notice as outlined below.

2. Submitting a Takedown Notice

To file a DMCA notice with us, you must provide a written communication that includes all of the following elements (as required under 17 U.S.C. § 512(c)(3)):

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing and that is to be removed, along with enough information for us to locate the material (including specific URL(s) if possible)
• Contact information of the complaining party, such as a physical address, telephone number, and email address
• A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in the notification is accurate and that the complaining party is authorized to act on behalf of the copyright owner

3. Counter Notification

If you believe that your content was removed by mistake or misidentification, you may submit a written counter-notification. Your counter-notification must include:

• Your physical or electronic signature
• Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed
• A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or the district where Pontopia is located), and that you will accept service of process from the person who provided the original takedown notice

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Pontopia.com has a policy of terminating, in appropriate circumstances and at our discretion, users who are deemed to be repeat infringers.

5. Disclaimer

Filing a false or abusive DMCA notice or counter-notification may result in legal consequences, including damages and attorneys’ fees under 17 U.S.C. § 512(f). Please consult legal counsel before submitting if you are unsure of your rights.
